Advice Group at III UBA Court Forum
This event is primarily organized for the lawyers, whose job is related to daily defense of clients’ interests in the court. Thus, Anton Podilchak attended III Court Forum of the Ukrainian Bar Association of Ukraine, which took place on October 3, 2014 at “Hilton” Hotel in Kiev.
The Forum does not lose its relevance, because there are always enough issues to discuss. However, if the legislator was previously the major theme supplier, now the social and political processes in the country become the determining factor or all branches of power, including judicial.
The Forum was marked by a record number participants, presence of interesting speakers and uniqueness of discussions. The Forum consisted of the most pressing and acute issues. Of course, judges and practicing lawyers, including representatives of Advice Group, discussed the most painful matters in civil, commercial and criminal proceedings, and also features of trials with international element.
The main themes for discussions were chosen, as follows:
Court reform within constitutional reform (in particular: regarding necessity of availability of commercial courts);
Mechanisms of bringing of judges to responsibility;
Mechanisms to ensure independence of judges;
Implementation of the law on recovery of confidence to judicial power, etc.
The highest officials of the judicial power came to share their vision on the future of the judicial system: Head of the Supreme Court of Ukraine Yaroslav Romanyuk, judge of the Constitutional Court of Ukraine Stanislav Shevchuk, Head of the Supreme Commercial Court of Ukraine Bogdan Lvov, Deputy Head of the Supreme Specialized Court of Ukraine on Consideration of Civil and Criminal Cases Yevgen Litvinov. The Forum was held with the support of the EU Project “Support to Justice Sector Reforms in Ukraine”, and the Head of Group of Experts of the Project, Virgilius Valancius, also contributed to the discussions on topical issues of the court reform.
Interest to the event and the range of discussed issues were so wide that the participants were divided into parallel sections, which were dedicated to specific aspects of proceedings. Ensuring the unity of court practice as a guarantee of improvement of investment climate of Ukraine, the latest trends in civil, commercial and criminal justice and peculiarities of international practice – all these issues were analyzed in details during the Court Forum, which was attended by the lawyers of Advice Group with great pleasure.
